BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE. 1. DEFINITIONS -------------------------------------------------------------------------------- - "Software" refers to "The Norns", including executable binaries (TheNorns.exe, TheNorns-Setup.exe), portable archives, configuration files, and associated documentation. - "Licensor", "We", or "Authors" refers to The Norns contributors and developers. - "Licensee" or "You" refers to the individual or entity that downloads, installs, or uses the Software. - "CCP" refers to CCP hf., the developers and publishers of EVE Online. 2. GRANT OF LICENSE -------------------------------------------------------------------------------- The Software is provided to you free of charge. Subject to the terms of this EULA and the underlying MIT License, the Licensor hereby grants you a personal, revocable, non-exclusive, worldwide, royalty-free license to install, run, and use the Software on your computer systems. The source code of the Software is distributed under the terms of the MIT License (available in the source repository). Nothing in this EULA restricts any rights granted to you under the MIT License regarding the source code itself. 3. EVE ONLINE, CCP GAMES & THIRD-PARTY COMPLIANCE -------------------------------------------------------------------------------- 3.1. Independent Fan Tool: The Norns is an independent, fan-made companion tool. It is NOT affiliated with, endorsed, supported, or sponsored by CCP hf. EVE, EVE Online, and all associated logos and designs are trademarks or registered trademarks of CCP hf. 3.2. Passive Operation & Policy Adherence: The Software is designed and engineered strictly as a passive utility compliant with CCP Games' Third-Party Developer and Fair Play policies: - The Software ONLY reads plain-text combat log files written by the EVE Online client to your local drive ("Documents\EVE\logs\Gamelogs") and standard operating system window titles ("EVE - "). - The Software DOES NOT read, inspect, or scan game client memory (RAM). - The Software DOES NOT inject code, DLLs, hooks, or debuggers into the game process. - The Software DOES NOT intercept or decrypt network packets. - The Software DOES NOT simulate, broadcast, or inject keyboard or mouse inputs into the game client. All game actions remain 100% human-driven. 4. IN-GAME ASSET & GAMEPLAY RISK DISCLAIMER -------------------------------------------------------------------------------- EVE Online is a competitive multiplayer game where spaceships, in-game currency (ISK), implants, and character assets can be lost permanently. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: - The Software is provided solely as an informational companion display. - Telemetry, DPS values, bounty tallies, faction spawn alarms, and hull heat alerts depend entirely on when the game client flushes text logs to disk. - Operating system file-caching, log-flush latencies, hardware limitations, or unexpected game updates may delay or prevent telemetry calculations. - UNDER NO CIRCUMSTANCES SHALL THE AUTHORS OR CONTRIBUTORS BE HELD LIABLE FOR ANY IN-GAME LOSSES, INCLUDING BUT NOT LIMITED TO: LOST SHIPS, DESTROYED FLEETS, LOST ISK, DESTROYED IMPLANTS, FAILED ANOMALIES, MISSED FACTION SPAWNS, OR ANY DISCIPLINARY ACTIONS TAKEN BY CCP HF. YOU USE THIS SOFTWARE AT YOUR OWN RISK. 5. PRIVACY & LOCAL DATA PROCESSING -------------------------------------------------------------------------------- - Offline by Design: The Software runs 100% locally on your computer. - No Accounts or Telemetry: The Software collects no personal data, no account credentials, no IP tracking, and transmits no analytics. - Network Usage: The sole outbound network communication is an optional, toggleable HTTPS request to the public GitHub Releases API to check for newer versions. This check transmits no information about you or your game clients and can be disabled at any time in Settings -> General or within the installer. - Local Storage: User configuration and historical session metrics are stored exclusively on your local PC in "%LOCALAPPDATA%\The Norns". 6. DISCLAIMER OF WARRANTIES ("AS IS") -------------------------------------------------------------------------------- THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE AUTHORS DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH FUTURE VERSIONS OF WINDOWS OR EVE ONLINE. 7. INDEMNIFICATION -------------------------------------------------------------------------------- You agree to indemnify, defend, and hold harmless the authors and contributors of The Norns from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Software or your violation of this Agreement. 9. TERMINATION -------------------------------------------------------------------------------- This Agreement is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and delete all copies from your systems. You may terminate this Agreement at any time by uninstalling and deleting the Software. 10. SEVERABILITY & ENTIRE AGREEMENT -------------------------------------------------------------------------------- If any provision of this EULA is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement, together with the MIT License for source code, constitutes the complete and exclusive statement of the agreement between you and the Licensor concerning the Software. ================================================================================
